Alors que, depuis quelques décennies, on tente de promouvoir des mesures de réinsertion sociale et de mettre sur pied des mesures pénales autres que l'emprisonnement pour favoriser l'inclusion et la réintégration dans la communauté, d'autres forces poussent plutôt vers l'exclusion des délinquants et des marginaux au nom de la communauté que l'on veut protéger. Les groupes qui s'affrontent sur la scène sociale ont des motivations et des intérêts divergents. L'article analyse le contexte et les facteurs macrosociologiques en jeu ainsi que les motivations plus ou moins explicites des différents acteurs sociaux.

It is now more than ten years (Landre ville, 1987) that I drew attention to a new technology for controlling delinquents: electronic surveillance (S.E.), normally called in English, « electronic monitoring » (E.M.), which was experimented with for the first time for misdemeanours in the United States in 1983. At first, it was used almost exclusively for «home confinement» or «home incarceration» - different types of confinement at home under electronic surveillance. However, the technology has developed rapidly, and new markets are being conquered, both in terms of those being detained and in terms of geographic spread. The technology has started to be used in Europe. The companies, as well as technical experts, have not stopped experimenting with new technological forms and new applications and have created means of surveillance which are more and more sophisticated. In this article, we survey the development of S.E. in North America and in Europe, looking at the diversification of the field of surveillance and at a number of criticisms of and reflections on this new method of control.

Abstract: This article gives an account of the compensatory work programme in the province of Québec, Canada, which is a success in the sense that, to a certain extent, it checked admissions for non‐payment of fines (the flow), and improved the quality of justice administration, but it has had no perceptible impact on the prison stock. It also discusses the danger of the political discourse and that of agencies that have an immediate interest in painting a glowing picture of the savings that would be realised by such programmes in reducing the prison population

Ces dernières années, la surpopulation des prisons américaines a suscité un grand intérêt pour ce que l'on appelle Home incarceration. Pour plusieurs, cette mesure est d'autant plus attrayante qu'elle peut être assistée par la surveillance électronique. La surveillance électronique des contrevenants a été proposée il y a un peu plus de vingt ans et les premiers projets pilotes, dans le système pénal, ont eu lieu en 1983 et 1984. Ils se sont répandus très rapidement, de sorte qu'à la fin de 1986, il y avait quarante cinq programmes du genre dans vingt états américains.
Après avoir exposé les techniques utilisées actuellement, l'auteur explore les avenues que pourrait emprunter cette technologie avant la fin du siècle. La seconde partie de l'article est consacrée à l'analyse des menaces pour les libertés individuelles ainsi que des risques d'escalade du contrôle pénal, que constitue la surveillance électronique. Enfin l'accent est mis sur le fait que cette technologie participera à la transformation du contrôle social.

Om te antwoorden op de vraag "kan de graad van recidive een criterium zijn van de doelmatigheid van de rechtelijke strafmaatregelen ? " heeft de auteur onderzocht in welke mate de recidive nuttige inlichtingen kan verschaffen m.b.t. de verwezenlijking van de doeleinden, die traditioneel werden toegekend aan de strafmaatregelen. Wet verstaat men in de empirische onderzoeken onder recidive en vooral wat meet men door de graad van recidive ?
Deze benadering, maar ook een analyse van de onderliggende postulaten van de officiële theoriëen over de strafrechtelijke inbreuk, over het proces van selectie van de misdadige bevolking en over de aard van deze bevolking leiden tot het besluit :
1. Sat de "graad van recidive" niet kan beschouwd worden als een criterium van doelmatigheid van de strafmaatregelen.
2. Sat men slechts tot een meer rechtvaardige ne meer menselijke sociale politiek kan komen zo men "de obsessie van de récidive" verlaat en de activiteiten van de strafrechtsbedeling zowel vermindert als controleert.

Les auteurs analysent certaines tendances contemporaines du droit pénal. Après un examen de quelques typologies pour cerner le droit-fiction, ils proposent un modèle des transformations récentes de celui-ci. A titre d'illustration, ce modèle est appliqué à l'évolution législative visant le contrôle de l'ivresse au volant au Canada.

A study of Québec penitentiary population trends from 1972 to 1991 (for sentences of 2 years and more), shows a marked ageing in individuals being admitted. After having presented the most pertinent data concerning age at admission, the remaining analysis focuses on some possible explanations for the incurred transformations: (a) the demographic hypothesis, (b) the relative reduction in young adults being admitted, and (c) the increase in older individuals. Although we should not ignore possible changes in delinquent behaviour, it would seem that the incurred transformations are foremost the result of societal reactions and modifications brought to penal policies and practices. Where the changes in the ratios of imprisonment and in the structure of the penitentiary population are concerned, the amendments to legislation, the decisions of those charged with devising the penal practices and those who have to apply them, such as the judges, must be considered as having as much importance as the alleged transformation of «criminality ».
